Terms, safety & liability
Effective October 20, 2026
Read this first
Sculpt ("the App") is offered by Mia Madeline LLC ("we," "us"). By creating an account, tapping a social sign-in button, or using the App, you agree to these Terms, Safety & Liability Waiver ("Terms"). If you don't agree, don't use the App.
Exercise can cause serious injury or death. Stop right away if you feel pain, dizziness, faintness, chest pain or pressure, shortness of breath, or anything that feels wrong. If it might be an emergency, call 911 or your local emergency number.
Section 15 has an arbitration agreement and a class-action waiver that affect how disputes are resolved. Please read it.
1. Not medical advice
Everything in the App (plans, lifts, videos, circuits, weight and rep suggestions, cardio, yoga, pilates, hydration reminders and anything else) is general fitness information for educational purposes only. It is not medical, physical-therapy, nutrition or professional advice, and it doesn't create any doctor–patient, trainer–client or other professional relationship.
Talk to your doctor before starting this or any exercise program, especially if you have or think you may have a heart condition, high blood pressure, diabetes, asthma, joint or back problems, a recent injury or surgery, are pregnant or postpartum, are over 40 and not used to exercise, take medication, or have any other health condition. Never ignore professional medical advice or delay getting it because of something in the App.
2. You take on the risks
You understand that strength training, cardio, yoga, pilates, stretching and every other activity in the App carry inherent risks, including but not limited to: muscle strains and tears; sprains; joint, back and neck injuries; fractures; hernias; falls; being struck or crushed by weights or equipment; equipment failure; overexertion; dehydration and heat illness; heart attack, stroke and other cardiac events; aggravation of existing conditions; and in rare cases permanent disability or death.
You choose to do these activities voluntarily, and you knowingly and freely assume all of these risks, known and unknown, even if they come from the negligence of the Released Parties (Section 3) or from errors in the App's content.
3. Release and waiver of liability
To the fullest extent the law allows, you release, waive, discharge and agree not to sue Mia Madeline LLC, its owners, members, officers, employees, contractors, guest coaches, content providers, licensors, partners and agents (the "Released Parties") for any and all claims, demands, losses, damages, injuries, illness, disability or death, of any kind, arising out of or related to your use of the App or any activity it suggests, including claims caused by the ordinary negligence of the Released Parties, inaccurate or incomplete content, video demonstrations, form cues, weight or rep suggestions, or plan design.
This release is binding on you, your heirs, next of kin, executors, administrators and anyone who might claim on your behalf, including in a wrongful-death claim, to the extent permitted by law.
Nothing in these Terms limits liability that can't be limited under applicable law, such as liability for gross negligence, willful misconduct or fraud in some states.
4. Videos, form and instructions
Exercise videos, photos, illustrations and written cues may come from third-party libraries, guest coaches, or may be computer-generated. They may contain errors, show imperfect or incorrect form, show a different variation, or not suit your body, ability or equipment. We don't guarantee that any demonstration is accurate, complete, safe or right for you.
You are solely responsible for learning and using proper technique, choosing safe loads, and deciding whether any exercise is appropriate for you. If you're unsure how to do a movement, get in-person instruction from a qualified, certified trainer before trying it. Don't do any movement that causes pain.
5. Weights, reps and automatic plans
Plans, starting weights, per-set weight increases, rep targets, rest times, 4-week rotations, cardio times and swap suggestions are generated automatically from the information you enter. They are estimates, not instructions. They can't account for your injuries, fatigue, form, health, sleep, equipment condition or many other factors. Always choose a weight you can control safely, and lower it or stop whenever you need to. You are responsible for any weight you lift.
6. Equipment, space and spotters
You are responsible for your workout environment: inspecting equipment before each use, following the manufacturer's instructions and weight limits, using collars, safety bars and spotter arms, using a spotter for heavy or overhead lifts, keeping a clear, non-slip area, wearing proper footwear, and following your gym's rules. We don't make, sell, inspect or maintain any equipment and aren't responsible for its condition or failure.
7. Health conditions and pregnancy
If you are pregnant, postpartum, recovering from an injury or surgery, or have any medical condition, only use the App with your doctor's approval and follow their limits over anything the App suggests. The App doesn't screen for health conditions and isn't designed for rehabilitation.
8. Weight goals, nutrition and body image
Weight and goal features are for general tracking only and aren't dietary or medical advice. Results vary and aren't guaranteed. Any "before," goal or example results aren't typical or promised. If you are struggling with eating, exercise or body image, please reach out to a doctor or the National Alliance for Eating Disorders.
9. Age requirement
You must be at least 18 years old to create an account or use the App. By using it you confirm that you are 18 or older. The App is not intended for children.
10. Guest coaches, partners and third-party content
Guest coaches and content partners are independent and are not our employees. Their views are their own. The App may include links, ads, sponsored content or third-party services that we don't control. We aren't responsible for them, and your dealings with them are solely between you and them.
11. No warranties
The App and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, safety, non-infringement, or that the App will be uninterrupted, error-free or secure, or that you'll reach any fitness result. Some places don't allow the exclusion of implied warranties, so some of this may not apply to you.
12. Limitation of liability
To the fullest extent the law allows, the Released Parties won't be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill, or for personal injury, property damage or death arising from your use of the App, even if advised of the possibility.
Our total liability for all claims of any kind related to the App is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $50. Some places don't allow these limits, so they may not fully apply to you.
13. You agree to cover us
You agree to defend, indemnify and hold harmless the Released Parties from any claims, damages, losses, costs and expenses (including reasonable attorneys' fees) arising from your use or misuse of the App, your activities, your content, or your breach of these Terms or any law.
14. Acceptable use and our content
Don't misuse the App: no copying, scraping, reselling or redistributing its content or videos, reverse engineering, interfering with its security, impersonating others, or using it for anything unlawful. The App, its name, logos (including Sculpt and Sculpty), design and content belong to us or our licensors and are protected by law. We give you a personal, limited, revocable, non-transferable license to use the App for your own non-commercial fitness. We may suspend or end access for anyone who breaks these Terms.
14a. Ownership, copyright and trademarks
The App and everything in it (the Sculpt and Sculpty names, logos and mascot, the design and layout, the code, the workout programs, plan logic, exercise lists, circuits, written cues, photos and videos) are owned by Mia Madeline LLC or its licensors and are protected by copyright, trademark and other laws. © 2026 Mia Madeline LLC. All rights reserved.
You get a personal, non-transferable, revocable license to use the App for your own workouts. You may not copy, clone, recreate, screen-record for redistribution, download, scrape, re-host, frame, sell, sublicense or make derivative apps from any part of it, or use our names, logos or mascot, without our written permission. We may take legal action, including takedown notices, against copies.
15. Disputes, arbitration and class-action waiver
Please read carefully. Except for small-claims cases and requests for injunctive relief over intellectual property, you and we agree that any dispute arising out of or related to the App or these Terms will be resolved by final, binding individual arbitration under the rules of the American Arbitration Association, instead of in court. You and we waive any right to a jury trial and to bring or join a class action, class arbitration or representative action.
Before filing, the person bringing a claim must first send a written notice and try to resolve it informally for 30 days. You may opt out of this arbitration agreement by emailing support@sculptfitness.org within 30 days of first accepting these Terms. Any claim must be brought within one year after it arises, or it is permanently barred, where the law allows.
These Terms are governed by the laws of the State of [State], without regard to conflict-of-law rules. If a dispute isn't subject to arbitration, it will be handled only in the state or federal courts located in [State].
16. Subscriptions, billing and cancellation
If you buy a subscription, it renews automatically at the price and period shown at purchase until you cancel. Subscriptions bought through the Apple App Store or Google Play are billed and managed by Apple or Google: cancel at least 24 hours before the renewal date in your Apple or Google account subscription settings. Deleting your Sculpt account does not cancel a store subscription. Refunds are handled by Apple or Google under their policies; except where the law requires, we don't give refunds or credits for partial periods. Prices and features may change with notice where required.
17. Your account and deleting it
Keep your login private. You're responsible for activity on your account. You can delete your account at any time from Profile → Delete account. When you do, your profile, plan, workout history, routines, body-weight log and sign-in details are cleared from the App, and you're signed out. We may keep limited records where the law requires it (for example, purchase records kept by Apple or Google).
18. Privacy and your data
Our Privacy Policy (Profile → Privacy policy) explains this in full. In short, we store what you enter to run the App: your first name, gender, age, height, weight, goals, equipment, schedule, workouts, lifts and logs, and your sign-in email or phone. Fitness and body information is sensitive, and we treat it that way. We don't sell your personal information. You can view and edit your answers in Profile, and you can delete your account at any time. We use a few service providers to run the App (for example for sign-in, storage and subscriptions); the Privacy Policy lists them. We don't show ads or sell your data. Questions: support@sculptfitness.org.
19. Changes and other terms
We may update the App or these Terms. If we make material changes, we'll let you know in the App; continuing to use it means you accept the new Terms. If any part of these Terms is found unenforceable, it will be enforced to the maximum extent possible and the rest stays in effect. Our not enforcing a provision isn't a waiver. These Terms are the entire agreement between you and us about the App. Apple and Google aren't parties to these Terms and aren't responsible for the App. Contact: Mia Madeline LLC, support@sculptfitness.org.
